Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the Never Late mobile application (the "Service" or "App") operated by Save Smart Group PTY LTD ("us", "we", or "our").
1. Acceptance of Terms
By downloading, accessing, or using the App, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.
2. Eligibility
By using the App, you represent and warrant that you have the legal capacity to enter into a binding agreement. If you are under 18 years of age, you confirm that you have obtained parental or guardian consent to use this App.
3. The "Never Late" Disclaimer (Crucial Notice)
Please read this section carefully. The name "Never Late" is a brand name and marketing title only. It is not a guarantee, warranty, or promise of results.
No Guarantee: We do not guarantee that the App will wake you up or ensure you arrive at any destination on time.
Device Reliance: The App relies on your device's operating system, battery life, volume settings, and hardware functionality. We are not responsible for alarm failures caused by dead batteries, "Do Not Disturb" modes, volume being muted, OS updates, or background process killers.
Limitation: You agree that you will not rely solely on this App for critical events (e.g., medical appointments, flights, job interviews) where failure could result in significant harm or financial loss.
4. User Accounts & Data
No Account Required: You do not need to create an account to use Never Late.
Local Storage: Your alarm settings, preferences, and custom recordings are stored locally on your device. We do not sync this data to a cloud server.
Data Loss: If you delete the App, lose your device, or reset your device, your data and custom recordings will be permanently lost. We cannot recover this data for you.
5. Subscriptions and Free Trials
To access the full features of the App, you must purchase an auto-renewing subscription.

Length of Subscription: 1 Year (Auto-Renewing)
Price: $39.99 USD per year
Terms of Subscription:
Payment: Payment will be charged to your Apple ID or Google Play account at confirmation of purchase.
Automatic Renewal: The subscription automatically renews unless it is canceled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the price listed above ($39.99 USD).
Free Trial: We offer a 14-day free trial for new users. Any unused portion of a free trial period, if offered, will be forfeited when the user purchases a subscription to that publication, where applicable. Unless you cancel at least 24 hours before the end of the trial period, you will be automatically charged the applicable subscription fee.
Management & Cancellation: You can manage and cancel your subscriptions by going to your account settings on the App Store or Google Play after purchase.
6. Refund Policy
All sales are final. As this is a digital product with an immediate free trial period for evaluation, we do not offer refunds for partial months or unused services. Any refund requests must be directed to the Application Store (Apple or Google) and are subject to their specific terms and conditions.
7. User Content (Custom Recordings)
The App allows you to record custom audio for alarms.
Ownership: You retain ownership of your recordings.
Restrictions: You agree not to record audio that is illegal, hate speech, or infringes on the intellectual property rights of others.
License: You grant us a license to process and play this audio locally on your device for the purpose of functioning as an alarm.
8. Intellectual Property
The Service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of Save Smart Group PTY LTD and its licensors. The Service is protected by copyright and other laws of the Republic of South Africa.
9. Limitation of Liability
To the fullest extent permitted by the law of South Africa: In no event shall Save Smart Group PTY LTD, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, loss of data, lost wages due to lateness, missed flights, or other intangible losses, resulting from your use of the Service. Our maximum liability to you for any claim related to the App shall not exceed the amount you paid to us for the Service during the 12 months preceding the claim.
10. Governing Law
These Terms shall be governed and construed in accordance with the laws of South Africa, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
11. Changes
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
